DEBT RECOVERY

We specialize in fast debt recovery (extra court claim) and also, if needed, Court debt claim to debtors.
We send a burofax to a debtor to claim the due amount, this is a kind of certificate letter by law, which is delivered through the postal service (Correos) in less than 24 hours. This burofax is effective, according to our statistics, at a 90% and it is considered the fastest, easiest and cheapest way to recover a debt.
In the case the burofax is unsuccessful we will deal with Court claim, called Proceso Monitorio, which was a procedure established in the new 2000 procedural Act in order to collect a debt between individuals or companies much faster. Through this procedure the creditor can seize and attach any asset the debtor could have, such as bank accounts, car, property or even shares in a company to get paid. The “Monitorio” can be lodged without a solicitor, although it is advisable to hire one to proceed with it, and ends with straight payment of the debt or, if it is not paid, with auction of assets until debt is paid up completely, and of course, the legal costs, so you don’t have to spend a lot money in lawyers. The maximum amount to be claimed in this procedure has increased since new amendment of the law was enacted a few months ago up to €250.000, before that it was €30.000.
There is another way to claim at Court and can be whether Juicio Verbal, if the amount is not over €6.000 or Juicio Ordinario if it’s over that amount. These two proceedings are more expensive and time wasting for clients.
